Ghost and Gas – No Conspiracies in Australia


It appears, the
Australian Competition and Consumer Commission do not know the fact that one can make millions of products out of a black substance called Crude Oil. The refiners make these products under certain conditions, pressure and temperature at the oil refineries based on the market requirement. Right now the main products in the Australian market are the L.P.G., petrol, kerosene, diesel and lubricating oil.

An intelligent organization with integrity must be watching all of these products, profit margins, price fluctuations and possible links behind any changes. According to
Mr. Graeme Samuel of the Australian Competition and Consumer Commission, his organization is only watching the unleaded petrol prices to change the world.

However, the giant ACCC and Australian Government got millions of well paid and connected advisers and experts. One can hope they will ensure public good and fairness while they discharge their responsibilities.

According to the law of the land, the bailor is responsible for fuel and wash.

However, at the Industrial Relations Commission the “taxi mafia” made an application to pass the responsibility of fuel and wash to the bailees without any compensation whatsoever.

Further to
ICAC Submission, long long ago; a “phantom strike” was called at Granville Taxi Base, Sydney, NSW of the ‘lucky country’! The TWU trouble shooter named Robert Mayell who used to work around the adjacent area quickly went over there and negotiated a settlement! The ‘Pay-in’ went down by five dollars!!

The following day, a number of taxi drivers were frog marched behind the “messiah” Robert Mayell at the Industrial Commission in front of CC Connor (NSW IRC Matter No 2383 of 1993).

No one is suggesting any conspiracy here! Poor Faruque and a few taxi drivers busted in anger and confronted the “messiah” Robert Mayell and the Transport Workers Union lawyer Adam Hatcher. During that time those new taxi drivers of Granville asked Faruque to be quiet and follow Meyall. Faruque told them, “I do not know who you are and I have not seen you in any of TWU meetings earlier – who are you people and what is the game going on here”?

Later many of these people confessed to Faruque and others that they were not even members of the TWU, many of them were not financial members of the union and the taxi bosses encouraged them to join in the TWU!

During the proceedings, the TWU lawyer said to CC Connor, “we reserve the right to oppose at a later date”.

The good CC Connor found the opportunity and then he keenly passed the responsibility of gas and wash to the bailees without any compensation whatsoever. He did so despite strenuous objections made to him by Faruque and other drivers.

The decision by CC Connor did not change the bailor/bailee remuneration principle or law, but he made a decision which was not opposed by the parties.
A few weeks later the LPG price jumped from $A0.20-$A0.30/L to $A0.50-$A0.60/L.

An application was made to the Australian Competition and Consumer Commission on a different ground. After a futile exercise, the price went down for a while.

Today, who is increasing the LPG price and on what basis no one knows or cares. The net impact is the weaker party in the chain is carrying the burden while “taxi mafia” is laughing all the way to the bank. The TWU lawyer Adam Hatcher found a chamber at the higher end of the town and become a BARRISTER! The good union boss Steve Hutchins became the president of the NSW Labor Party and eventually a number one ticket SENATOR from NSW.

Taxi drivers made an appeal to the Full Bench.

After a long and costly exercise, we found out that only the TWU have the right to represent taxi drivers at the Industrial Commission! During that hearing the rights and wrongs of the actual case were not discussed.

That means, in reality the court said the TWU can do whatever they like and they can ignore their own taxi driver members all together or their welfare! They are virtually not answerable to anyone. The union bosses do not have to follow justice, fairness, courtesy or common sense! Since then the union removed a few bi-laws of their own constitution i.e. they don’t have to advance the well being of their own members”. The law is same today.

Whether we drivers like it or not, even if the TWU got any taxi driver members or not they will decide the bailee taxi drivers working conditions. No matter, how sad, immoral and unlawful they are.

Faruque and others used to expose them in the media. However, the union bosses used to make attempts to trap taxi drivers and block them from the media, parliament, etc. etc. Some of the documents are very revealing.

I say, the most tragic thing of my life is that knowing and dealing with the NSW Transport Workers Union.

Faruque reckons taking this to the IRC for review is too difficult and costly. He reckons Parliament, somehow. Any specific advice, Faruque?Ernie suggest IPART gives us a handout for fuel price increases. That's the easiest approach, no doubt, albeit in June/July from memory and a massive amount of work if we do the full Monty! (Should IPART be added to our Calendar?) The other string in the bow would be the currently poor responses to radio booking which are now even less attractive than before. Macquarie Bank's Max Moore-Wilton complains about lack of peak hour taxis (as well as quarantine queues and rail service) at his Sydney Airport (SMH 7 Dec 07 p4).

Neither the Government nor the taxi industry owes Max (the Axe) anything, let alone preferential taxi treatment for Mr. Moore's money making machine. Mr. Moore might do much better with tried and proven private enterprise incentives for taxis to come to his airport.

Taxis are forced to pay a $2.50 toll which they then have to retrieve from Mr. Moore's passengers. Instead, a peak hour incentive payment to taxis for servicing Mr. Moore's passengers might improve his service for airport passengers. Together with improved respect from Mr. Moore's airport 'security' staff and airport Police (ban all Capsicum spray on taxi drivers), improved taxi queuing arrangements and driver facilities, would all lift Macquarie Bank's taxi services for its flying public. Improved taxi services for airport travelers are entirely in Mr. Moore's hands!

Channel 9 reports that Police are stopping/booking taxi drivers for not picking up passengers.

The relevant Regulations are that taxis need not pick up passengers at night between the changeover times from 1.30 to 4.30AM. For safety reasons taxis also need not pick up passengers who are intoxicated or problematic.

On behalf of taxi drivers the NSW Taxi Drivers Association asks the Minister for Transport and the Commissioner for Police under whose authority Police are stopping taxi drivers? And the NSW TDA asks under what Regulations are Police stopping taxi drivers?

During Christmas the problems of people getting home at night are severe because buses and trains stop running long before people want to go home. Only buses and trains can move the large crowds of partygoers during December. Only buses and trains operating until 4AM can get the majority of people home. Taxis can never handle such large crowds of people.

Taxi drivers will take all the passengers they can to earn an extra quid. Police stopping them from their work are only making the December situation worse. A simple electronic destination sign could avoid frustrations! So let’s look for solutions rather than passing bucks.

Police needlessly stopping taxi drivers for not picking up people may be distracting the public from the real problems of the lack of late night buses and trains for the public at Christmas. Are these Police actions deliberately distractions from the real problems of lack of December late night public transport by the Iemma Government?

Dear Mr. Samuel,

I request that the ACCC move to take action forcing requirement that taxi entities be compelled to remove from surface areas of taxi cabs, decals proclaiming and advertising Cabcharge products.

Originally taxi cooperatives (not taxi companies or networks) obtained "the authorisation in contention" to subject workers in the taxi cab industry to perform for Cabcharge from the then Trades Practices Commission by not telling the truth, twisting the truth and using racism. Ultimately, the original applicants, specifically the Red and Yellow Deluxe have used many false claims "for their own narrow benefit" with impunity.

Fortunately this issue was largely dealt with to my satisfaction in TPC in matterA30152.

Since then, we have been asking the ACCC and other relevant departments to remove the Authorization A30112. Surprisingly, they are very reluctant about it.

Finally, in Matter No - 3 of 2005 of the Australian Competition Tribunal, Justice Goldberg and three other eminent Judges revoked the contentious authorization which gave the Cabcharge the “exclusive power” and “monopoly” in the first place. It is interesting to note that during the proceeding neither the taxi network nor the Cabcharge made representation as to the (their) case.

The fact is, the then TPC then made a mistake back in 1984- since then the Federal Competition Tribunal corrected the anomaly.

The ACCC used it’s power, authority and creativity to compel all taxi owners of this country to display the Cabcharge decals and therefore accept the Cabcharge cards and dockets.

Now, the ACCC must do everything to remove the Cabcharge decals from all taxis as they are false advertisement and NOT legally required in the first place.

The NSW Taxi Drivers Association is pleased to help Miranda with some arithmetic to solve the problem of Xmas party goers getting home in November and December each year.

There are 5000 taxis in Sydney. Each can take between 1 and 4 revelers home, on say a 15 minute trip and 15 return to the City, for 6 persons per hour. Working from 10pm till 4am in the morning, Sydney's taxis can therefore take home some 200,000 persons (6 pax x 6 hours x 5000 cabs approx). That's a far cry from Miranda's million, even with the addition of "gypsy" cabs, wherever they may materialise from.
On the other hand, only 1000 buses carrying 60 people can take about 350,000 people home during that period. And 100 trains with 1000 persons can carry 600,000 revelers home in that time. Like they do in weekday peak hours. That takes care of most of Miranda's million revelers. Of course 1000 extra bus divers and 100 train drivers would have to be paid overtime to work those nights.

Based on simple arithmetic, trains and buses are the easy, obvious and only solution to the traditional Xmas problems that Miranda correctly identifies.

Miranda’s Xmas and Taxis




Miranda has put her elegant finger squarely on the problem of taxis at Xmas (SMH 8Nov07). Each year in November and December it becomes increasingly impossible for office and Xmas party goers to get a taxi home late into the night.

This is despite most taxis working flat out those months to make up for their paltry earnings during the year, when too many taxis are idle. The Xmas taxi problems are a major issue for the NSW Taxi Drivers Association which is concerned about driver earnings as much as taxi services to passengers whence drivers derive their earnings.

The problem at Xmas is that taxis can generally carry only take 4 persons per cab. Unfortunately, two or 3 times as many cabs or "gypsy" cabs are a Miranda mirage, idle the rest of the year. In any event they could still not carry the Xmas crowds. The millions of Xmas revellers that arrive by trains and buses during the day, can only get home if those trains and buses are running to get them home again late at night.

And there Miranda lies the answer. Trains and buses must run until 4am during the Xmas season to get people home. Then the taxis can cope with the "mopping up" and the other fares.

Herewith is a suggested draft Agenda for your comments, please.

The SACL top management meeting has been the initiative of the NSW TDA resulting directly from proposed Direct Action.
The SACL, Colin Grove, expects us to suggest issues arising for discussion (as he asked and as reported on Friday).
He will also no doubt expect the NSW TDA to be strong minded, clear and determined in its aims and goals, and businesslike. The Agenda should assist that.


CONTEXT OF MEETING AND OUTCOMES
SACL top management is very aware that :
- driver feelings are high as a result of the Capsicum incident.
- that drivers at the Airport are prepared to take Direct Action
- that the NSW TDA is prepared to organise Direct Action, but prefers to resolve issues in discussion
- that the NSW TDA is concerned to ensure that Capsicum need never again be used with taxis at the Airport.
- and therefore the need to minimise or eliminate any and all underlying circumstances at the Airport that could possibly give rise to such situations.

The best outcome from this meeting for drivers, NSW TDA and SACL is top management :
- made clearly aware of those specific factors giving rise to stress among drivers,
which are Airport matters, in the control of the Airport, and that many of these can be minimised and / or eliminated
- and SACL top management to issue instructions and ensure that such stress related Airport matters are urgently resolved


Accordingly, the following issues are suggested as Agenda topics for meeting discussion.
They are culled from Ernie's letter, Faruque's email and Brian's thoughtful suggestion yesterday.
(There are many other matters concerning the Airport not listed. The ones below are those that frequently create stress at the airport and could result in violent incidents. And which, if addressed and resolved reduce stress situations and the possibility of violent incidents)


DRAFT AGENDA -- 9AM TUESDAY 23 OCT07.


WILSON STAFF
(Complaints of bullying and cajoling Taxi Drivers. Drivers ordered to carry more than their prescribed number of passengers, to carry babies without safety capsules, confiscated driver personal effects, entry by passengers blocked to taxis, lack of normal courtesy in dealings with taxi drivers. To minimize disputes kerbside staff should to wear clearly identifiable markings. Training improved, with better understandings of the roles and limits of Wilson staff and the nature, role and work of taxi drivers.)

AIRPORT FINES
(Airport taxi fines are hugely excessive, disproportionate, unnecessary, often arbitrary and a major source of taxi driver grievances.)


E- TAG PROBLEMS
(Contingency arrangements for rejected E-tags, such as deferred toll payment scheme, or voucher payment, is essential to contain the E-tag furore . Taxis called at the end of the day to be exempted from the toll if the supply of passengers is exhausted.)

MoT TAXI INSPECTIONS
(MoT taxi inspections are not a driver responsibility. Such inspections irritate drivers queuing for fares, and should be carried out at taxi bases, not the Airport.)


TRAFFIC ISSUES
At both domestic and international airports, in holding bays, escape routes, passenger pick up, set off.
Right lane of the down ramp from domestic Qantas departure to the entry corridor for taxis to reduce the ramp congestion and facilitate holding area entry. That the Shiers Ave entry point to the domestic corral be moved before the Sir Reginald Ansett Dr for safety and traffic flow. )

Constructive Dialogue vs. Industrial Action



Following the unfortunate altercation between a taxi driver and a member of the police services last Tuesday morning (16/10/07) at the Sydney International Airport taxi rank, the NSW Taxi Driver's Association (NSW TDA) and its members, have resolved to remain united and therefore seek to find a peaceful solution.

The NSW TDA is encouraged to this end after contact was made with Mr. Russell Balding, the CEO of the SACL, who indicated an agreement to enter into urgent discussions to avoid any potential industrial action affecting the airport operations.

A formal meeting is scheduled at the first available opportunity between the parties. We are hopeful that these discussions will prove fruitful in resolving both the immediate issue and open the doors for dialogue on a range of grievances related to the transport operations at the Airport.

We also urge all taxi drivers to maintain their cool and continue the patient and united watch over the current developments.

TAXI DRIVER CAPSICUM SPRAYED AT AIRPORT.


A serious incident has occurred today at the International Airport involving a taxi driver. Police sprayed a taxi driver doing his job at the Airport with capsicum spray.

Such an incident has never occurred before. Sydney taxi drivers are deeply concerned. The details and the reasons for this incident are not yet clear.


The NSW TDA is most concerned about the taxi driver and his welfare. The NSW TDA is also alarmed by the excessive use of force.

There have been and continue to be a number of matters of concern to taxi drivers at the Airport.

The NSW TDA has arranged an urgent meeting with the Airport authorities on Thursday 18 October to immediately discuss and resolve the serious and unfortunate incident that occurred today. It will also seek to resolve other outstanding issues at the Airport.

During the Annual General Meeting held by the New South Wales Taxi Drivers Association on Sunday September 2nd 2007, a crucial decision was made by the membership present to totally expel two founding members of the association.

These members Mr. Michael Jools and Mr. David Bradley were removed from the books of the association having held senior administrative roles in the past.

The case of Mr. Jools being that of President of the association due to serious administrative breaches within the association. Mr. Jools was originally suspended from the role of the executive committee of the New South Wales Taxi Association back in December 2006 for disruptive and undesirable conduct at committee meetings. The committee decision for his expulsion was endorsed by the membership in a majority vote at the Annual General Meeting on September 2nd.

David Bradley’s expulsion came about due to him being voted out of his previous executive role back at the Annual General meeting in August 2006. Having thus being voted out and being in control of the association’s website which is a registered domain name he has refused on repeated requests to release the domain name of the website to the appointed and elected website managers and allowed for derogatory publications to appear on the associations website confusing members as to the progress and activity of the same.

All interested parties are hereby notified that neither Michael Jools or David Bradley are in any way, since the meeting of September 2nd 2007. associated or directly involved with the New South Wales Taxi Drivers Association. Any correspondence from Michael Jools on the New South Wales Taxi Drivers Association letter heads to be considered fraudulent.

Dear Mr. Jools,
I too would like to see unity to progress the taxi industry. The question is "How can that be achieved?" You have pointed to bullshit, vile hatred and venomousness from Mr. Hirsch, Mr. Faruque and Mr. Lindholdt. If their comments fitted those definitions I could point to the same from Mr. Bradley, Mr. Nelson, Mr. West and your good self, all perpetual committee members of the ATDA.

Has it occurred to you that this style of "debate" is counterproductive to the objective of unity, that it creates division rather than unity and that it is within your power to do something about it? All you have to do is to ask your supporters to present your case clearly and logically without resorting to personal insults. Then, perhaps, the other side will follow suit and objective discussions could be had on the merits of the issues rather than on the merits of the personalities involved.

You are a very prominent figure in the taxi industry and as such you have a lot of influence over drivers. Why not reflect on your own actions and ask youself whether they have contributed to unity or not?In another post you referred to a minority of unruly people who disrupted the meeting at which the current committee of the NSWTDA was elected.

Is it possible that those people actually displayed unity by working together to get the committee that they wanted to represent them? I believe that your response was to reject their wishes by refusing to work with that committee. If that is so, would that foster unity amongst drivers?

Subsequently you formed the Australian Taxi Drivers Association along with the former committee members of the NSWTDA to do exactly the same things. Would that foster unity among taxi drivers? Since then members of your group have constantly attacked the committee members of the NSWTDA on it's own forum, stifling any debate on any other topic. Would that foster unity amongst taxi drivers?

All the committee members af the ATDA including you want to retain their membership of the NSWTDA and stand for election to it's committee. Does that foster unity amongst taxi drivers?

You have proposed a change to the constitution of the NSWTDA which would make it impossible to change the members of the committee, as is the case in the ATDA. Would that foster unity amongst taxi drivers?

Most recently you have commenced legal action against the NSWTDA and Mr Hirsch. Will that foster unity amongst taxi drivers?Maybe I don't understand your definition of unity. Perhaps you would be kind enough to explain to me and everyone else on this forum what unity is and how it works.

Under my definition of unity I think you could make a huge contribution by eating a bit of humble pie and smoking the peace pipe.

PUBLIC TRANSPORT SYSTEM CONTROLLED BY TAXI BOSSES
A. The taxi companies inspect their own taxis under the guise of Authorised Taxi Inspections Schemes (ATIS). Unlike moving vessels such as trains, planes, ships and other plant and equipment a taxi cab operator is not obliged under the law to go through a Check List prior to the commencement of a shift, or at any time! This is a deliberate ploy to remove, or at least reduce, the quality control and quality assurance of NSW taxicabs, and it is detrimental to the interests of taxi drivers and their passengers.

B. Taxi companies and radio networks are not answerable to the NSW Department of Transport, and their failure to comply with regulations does not attract any penalties whatsoever! That's why they are deliberately running down their taxi radio networks, contrary to the interests of the traveling public and taxi drivers. The radio networks make more money if fewer drivers and passengers use their systems due to the guaranteed income protection mechanism built in to the NSW Passenger Transport Acts and Regulations.

C. Despite many valid requests the taxi companies are not obliged to provide a safe workplace under the Duty of Care provisions of the Occupational Health and Safety Acts! Taxi companies collected a lot of money from taxi drivers and passengers under the guise of taxi driver safety and then gave us virtually nothing!

The NSW Ombudsman said, "the Department of Transport is CAPTURED by the NSW Taxi Council". The NSW Independent Pricing and Regulatory Tribunal (IPART) said, "the NSW Department of Transport is EVASIVE, not forthcoming". Taxi drivers believe that the NSW Taxi Council Pty Ltd and Cabcharge Pty Ltd control the NSW Department of Transport!

The NSW Passenger Transport Act and Regulations allow the NSW Taxi Council Pty Ltd, Cabcharge Pty Ltd, taxi companies and taxi networks to get away with murder! The long awaited proposed Transport Regulations continue in this tradition of deliberate negligence and neglect! Should you wish to have a safe and secure taxi industry, as well as a fair and balanced society, then please ask questions of members of Parliament, the media and community activists about the issues outlined above.

According to a few media reports, it appears, your department is using the Bulldog Scandal graduate Mr. Dave Madden and his ‘out of touch’ and elite report to
incite racism and prejudice against taxi drivers similar to Dr. Mohamed Haneef scandal as confirmed by former Prime Minster Paul Keating.


The communication of 1995 and reply thereby do not support to day’s racist outburst. On that time, “The number of taxi drivers suffering from communication problems (e.g. English)” was less than 8% and the department told us, “things are improving”. So, what is the real story? Where is the truth? Who have been issuing taxi drivers authority to people with no communication skills and why?

One must wonder why the hell your proposed regulatory changes are providing the ‘taxi mafia’ a licence to murder anyone without any constraint whatsoever and crucifies taxi drivers all the time without any good reason?

The attached Media Releases and article ‘
Robert Woodger’ clearly demonstrate the deliberate negligence of the NSW Labor Government regarding the taxi drivers’ safety.

It also appears A Mr. Michael Jools is complaisant to kill the draft and final Cook Reports under the guise of ‘confidentiality agreement’ initiated by your government. It also appears you people are loath to consult with the workers in the first place as it is the case in this matter.

One must wonder, what kind of government would play cruel jokes with the taxi drivers’ safety as your government has done over the last 11 years?

I would like to have a proper response about taxi drivers safety issues ASAP.

We the NSW Taxi Drivers Association express our deepest sympathy and condolences to the tragic loss of our colleague Robert Woodger, which might have been avoided. We renew our pledge to ensure that Robert's death won't be in vain.
A few brave drivers initiated the long overdue taxi drivers' safety issue. Since then a few items like cameras, Global Positioning System and the hopeless safety screens found their way to the industry. The public and the drivers paid enough money to fund such programmes through $1.00 flag fall rise and the resultant 80/20 split ($16.00 + $24.00 = $40.00 per day). The taxi companies took the money and played a sick joke with our safety. The NSW Labour Party led government ignored the good works of the following reports:
1. Driving Forces (Minister for Industrial Relations and the Attorney General),
2. Driving Forward, (Minister for Industrial Relations and the Attorney General),
3. Keatsdale Report (The DoT and NSW WorkCover Authority),
4. Dalziel Report (Sydney University) and
5. Alan Cook reports.
Our predecessor, the NSW CWA in their Media Release warned the government in advance. Yet three years later, the current `elite' David Madden report of 2006 following the Youbert Hormozi murder is gathering dust on the Ministerial shelf. The culture of neglect, profit and arrogance has overtaken public and drivers safety. The long overdue and repeatedly requested legislative framework to ensure the proper adherence and enforcement of the Duty of Care legislations under the Occupational Health and Safety Act remained elusive as ever! The cry for a public education campaign has fallen on deaf ears too.
We appeal for an open and fair debate and discussion regarding taxi drivers' safety to save lives like Robert Woodger.

We welcome the general thrust of the recently released Cook Report. We also welcome Minister Costa's expressed desire to consult with the service providers rather than usual "suspects" who are in so many ways responsible for the mess in the taxi industry.

However, the association cannot ignore the manoeuvrings behind the scene to predetermine the outcome of the final report. Specifically, the control mechanism adopted by the same bureaucrats who by their own actions and omissions allowed the lawlessness and reduction of service quality as well as compromised accountability and lack of transparency in the taxi industry. The Taxi Task Force must be free and unencumbered in its reform agenda.
For the greater good of the industry and community, the Association has decided to merge with the NSW Taxi Drivers Association. We hope the virtually member-less Transport Workers Union will do the same instead of acting against the wishes and interest of taxi drivers. Our extensive membership has voted to move over to the NSW TDA and as activists we shall be working towards the total coverage of taxi drivers by that Association.We will go forward under the Yellow Ribbons of Taxi Unity.

The shameless, greedy and opportunist Michael Jools is not only a professional looser; he is also a serial bankrupt. Late last year, he had almost bankrupted the poor NSW Taxi Drivers Association. He did so by withdrawing money from the NSW TDA savings funds without any approval of the committee and many of those spending lacks proper explanation. I have recommended a Fraud Squad Investigation to deal with the matter.

However, Jools has not forgotten the smell of the cash. He found out, even after his cruel misappropriation of the TDA funds, the association got some money. So, he dared to propose five amendments to alter the NSW TDA constitution as mentioned in the “
House of Australian Vagabond Dictators“ below. In doing so, he and couple of his cult followers will grab the key and eat out poor NSW TDA money. One must wonder what kind of greedy control-freak would propose such amendments and what kinds of cult followers would accept them anyway!

Not only this, it also appears, Jools mislead everyone in the church during the funeral of Robert Woodger, in front of God and dead body of Robert as he is a party to kill the Cook Reports with the Department of Transport and thereby taxi drivers safety in general.

Considering the greedy nature of these creatures, I hereby propose, greedy Jools and Bradley should be expelled from the NSW TDA because of their converse conduct and disruptive behavior as well as the Ministry of Transport should be haunted for their share of crime too.

5.11 Removal of an Officer or Serving Member of the Committee.
A meeting of the Committee may suspend or remove by passing a resolution any person on the Committee other than a Founding Member (do you mean those sacred cows!) from their position before the expiration of the person's term of office where the person concerned has shown a gross dereliction of duty and has acted persistently in a manner prejudicial to the interests of the Association.

4.2 The Committee will consist of the foundation members (holy Brahmins) and those and or other nominated and or appointed members will constitute the listed office bearers.

3.10 Foundation Members The Foundation Members of the Association are David Bradley, Mohammed Hadid, Michael Jools, Ross Nelson and Michelle Strathmore (Is it because many of them are serial bankrupts, professional cheats and shameless enough to use taxi drivers for their narrow personal gains?). The Foundation Members may by, simple majority vote, elect replacement or additional members from time to time as may be necessary to retain five active members.
20 Alteration of the Constitution This constitution and rules hereunder shall be altered, rescinded or added to by only a special resolution passed by the committee of founding members (Do you mean gang of five dictators?) in full session.[ Note the application of 15.2]

Submission Re: Matter No - 3 of 2005Australian Competition Tribunal

I have made the submission below earlier and recognised by hishonour. I would like to make a few more points due to some structuraland circumstantial changes in the taxi industry. For the sake ofaccountability and transparency, I also would like to declare that Iam an elected member of the NSW Taxi Drivers Association's executivecommittee.

The Submission:Taxi co-operatives (not taxi companies or networks) obtained "theauthorisation in contention" by not telling the truth, twisting thetruth and using racism as well as some other false claims they madeto misguide the then Trade Practices Commission. Ultimately, theoriginal applicants, specifically the Red and Yellow Deluxe have usedmany false claims "for their own narrow benefit" and got away withthem. Fortunately most of their typical false claims and lies weredetected and eventually correctly rejected by the TPC in matterA30152.

The Australian Competition Commission should have continued theirstand and withdraw the authorisation! Yet, reason not known to us;they have not done so. As a result we are in front of this Tribunalright now.
Some privately owned entities of the taxi industry argued, "taxidrivers' do not have any right to represent themselves in thistribunal or any where else". A claim of such a nature ought to besurprising, harsh and unjust as some "mysterious identities" can'tand must not be representing taxi drivers! To his wisdom, JusticeGoldberg accepted Mr. Michael Jools, President of the NSW TaxiDrivers Association as a party and asked me to contribute in thematter. After a long and costly journey, the private entities of taxiindustry have decided not to contest us in this matter. I thoughtthis is a signal of accepting the defeat because they do not have anyvalid response to our long and valued submissions.
However, The Australian Competition Commission has now decided tospend tax-payers' fund to defend the indefensible, e.g. defending theprivately owned Cabcharge Limited's interest in this tribunal isbeyond my comprehension.
Part of my earlier submission:
I the undersigned, Faruque Ahmed, have been advocating bailee taxidrivers' rights and interests in the state and federalinstrumentalities, Parliaments, media, before the AustralianCompetition and Consumer Commission and formerly the Trade PracticesCommission as:
1. Secretary/Treasurer and President of Taxi Drivers' Section of theNSW Transport Workers Union, respectively,
2. Vice-President and President of Taxi Industry ServicesAssociation, respectively and
3. President, NSW Cabbie Welfare Association.
I am also a working bailee taxi driver. Any decision made by the ACCC and this Court regarding the Cabcharge Taxi Authorisation directly affects me as:
1. I am currently compelled to work for Cabcharge Limited for 30minutes per shift free of charge,
2. I am compelled to bear the burden of any dockets voided byCabcharge for reasons beyond my control or ability, thus eroding myindustrial rights,
3. I am compelled to bear the burden of traffic fines that incurredwhilst processing Cabcharge dockets and credit cards,
4. I am compelled to provide my private details to a company withwhom I have no contractual relations, and
5. Because of my free labour and miseries mentioned in "1" to "4"above the Cabcharge is making huge amount of money and buying upvarious taxi industry instrumentalities and thereby reducing andeventually destroying competition in the taxi industry,
6. The State and Federal Government provided unfair advantage toCabcharge are effectively restricting any new comers to open up anynew ventures in the taxi industry,
7. I have made Submissions on this particular matter to the ACCC.
8. I have had several conferences with officers of the ACCC, at theirrequest, on this particular matter.
